LIABILITY WAIVER AND INDEMNIFICATION

Workshop participants will be required to acknowledge a personal injury waiver in the form of a LIABILITY WAIVER AND INDEMNIFICATION document. The text of this document is embedded in the Registration form, and registrants will acknowledge this by checking a box and typing their name (signature) and a designated space. As some registrants are eager to submit their forms, we encourage you to read the waiver ahead of time to be certain you are able to agree.  We do not anticipate that the workshop will be any more or less hazardous than any previous basketry workshop you may have experienced, but there are potential hazards associated with any endeavor and we wish to ensure that Participants are aware of these and agree to assume their own personal responsibility. TEXT OF WAIVER:

“NWBW Basketry Workshops may involve a variety of hazards, including, but not limited to: sharp tools, propane flames, boiling water, toxic chemicals, potentially allergenic plant materials, pathogens, and disruptive or aggressive behavior from other participants. By registering for this workshop, you assume all risk of personal injury, property damage, and even death, arising out of or associated with your participation in the workshop. 

YOU AGREE TO RELEASE AND HOLD HARMLESS the Northwest Basket Weavers, Vi Phillips Guild, along with its trustees, officers, directors, members, employees, agents, volunteers, contractors, insurers, and successors, and all contracted or volunteer instructors present at the workshop (collectively, the “Released Parties”), for any and all claims, damages, and attorneys’ fees, whether sounding in contract or tort or any other cause of action (excluding only gross negligence and intentional misconduct), arising out of or associated with your participation in the workshop (“Claims”). 

YOU AGREE TO DEFEND AND INDEMNIFY the Released Parties regarding all Claims, whether asserted by you, any other member of your family or household, or any other person or entity (including any trust or estate).

If you are registering a minor under age 18, you represent that you are over age 18 and that you have authority to sign this Liability Waiver and Indemnification on the minor’s behalf, and you agree to defend and indemnify the Released Parties against all Claims asserted by or on behalf of the minor.

You agree that all disputes arising out of or associated with your participation in the workshop shall be governed by Washington law, exclusive of choice of law principles, and shall be adjudicated in the state and federal courts of King County, Washington.
